These Terms of Service ("Terms") govern your use of the website webdesignusa.site and the services provided by Web Design USA, a division of MillionaireHost Group ("Company," "we," "us," or "our"). By accessing our website or engaging our services, you agree to be bound by these Terms.
1. Services
Web Design USA provides web design, branding, digital marketing, WordPress development, Shopify development, custom software development, AI automation, and web hosting services. The specific scope, deliverables, timeline, and pricing for each project are agreed upon in a separate project proposal or Statement of Work (SOW).
2. Project Agreements
Each project is governed by a project proposal that outlines:
- Scope of work and deliverables
- Project timeline and milestones
- Total investment and payment schedule
- Revision policy
- Launch and handover process
The project proposal, together with these Terms, constitutes the entire agreement between you and Web Design USA for that project.
Payment Terms
All prices are listed and payable in United States Dollars (USD).
Projects with a total value of less than $1,000 USD require full payment upfront before work begins.
For projects valued at $1,000 USD or more, the standard payment structure is:
- 50% deposit required before work begins
- 50% due upon project completion and before final files, website access, or ownership transfer is provided
For website hosting services, billing is conducted annually unless otherwise agreed in writing.
All outstanding balances must be paid within 7 days of project completion or website launch unless additional revisions, approved change requests, or ongoing development work are still in progress.
If a website is launched and the final balance remains unpaid after 7 days, Web Design USA reserves the right to temporarily suspend the website, hosting services, or related deliverables until the outstanding balance has been paid in full.
Late payments may result in project work being paused until payment is received.
Invoices that remain unpaid for more than 30 days may incur a late payment fee of 1.5% per month or the maximum amount permitted by applicable law.
Web Design USA reserves the right to withhold final website files, administrative access, source files, design assets, licenses, credentials, or other deliverables until all outstanding invoices have been paid in full.
These payment terms may be modified, waived, or adjusted for existing clients, long-term customers, internal customers, enterprise projects, or special package arrangements at the sole discretion of Web Design USA.
4. Revisions
Our packages include unlimited revisions within the defined project scope. Revisions that fall outside the agreed scope may be quoted and billed separately.
5. Client Responsibilities
You agree to:
- Provide timely feedback, content, and approvals needed to complete the project
- Ensure all content, images, and materials you provide are owned by you or properly licensed
- Designate a primary point of contact for the project
- Not provide infringing, defamatory, or illegal content
6. Intellectual Property
Upon receipt of full payment, you own all custom design work and code created specifically for your project. Web Design USA retains the right to:
- Display the completed work in our portfolio
- Use the project as a case study in our marketing materials
- Retain ownership of any pre-existing tools, frameworks, templates, or code libraries used in the project
7. Third-Party Tools & Licenses
Some projects may utilize third-party software, plugins, fonts, stock images, or services that require their own licenses. You are responsible for maintaining any required licenses after project handover. Web Design USA will advise you of any ongoing licensing requirements.
8. Hosting Services
Web hosting services are provided via MillionaireHost infrastructure. Hosting is subject to:
- Fair use and acceptable use policies
- Annual renewal at $99/year after the free hosting period ends
- Web Design USA reserves the right to suspend hosting for non-payment or violation of acceptable use policies
9. Limitation of Liability
Web Design USA's total liability to you for any claim arising from our services shall not exceed the total amount paid by you for the specific project giving rise to the claim. We are not liable for indirect, consequential, incidental, or punitive damages.
10. Warranty Disclaimer
Our services are provided "as is." We do not guarantee specific business outcomes, search engine rankings, conversion rates, or revenue results from our work. Past results in our portfolio are not guarantees of future performance.
11. Confidentiality
Both parties agree to keep confidential any proprietary information shared during the project. This includes business plans, financial information, client lists, and technical information.
12. Termination
Either party may terminate a project with 14 days written notice. Upon termination:
- You will be invoiced for all work completed to date
- Any deposit paid is non-refundable for work already completed
- All completed work will be delivered upon receipt of final payment
13. Dispute Resolution
Any disputes arising from these Terms or our services shall first be addressed through good-faith negotiation. If unresolved, disputes shall be subject to binding arbitration in Las Vegas, Nevada. These Terms are governed by the laws of the State of Nevada.
14. Changes to Terms
We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page. Continued use of our services after changes constitutes acceptance of the new Terms.
